Foreclosure process
In the state of Iowa, most foreclosure proceedings fall und what is called "Judicial Foreclosure". This means that the lending institution has specific rules they need to follow in processing the forelcosure. In this process the lender must begin by filing a case with the local clerk of court. The case will then proceed through the court system, being heard by a judge. The lender will have their attorneys representing them and it is highly recommended that you have an attorney representing your interest. Eventually, the case will come to a conclusion where either the case is dismissed and you keep your home, or the lender receives the judgement they have been seeking and your home is scheduled for Sherrif Sale. So how can you stop this?
stopping the foreclosure
There are many ways to stop a foreclosure. We will be dealing with what DM Homebuyers can do to assist you.
If you have equity in your home(your home is worth more than you owe), then you have a good situation where you can sell the home to DM Homebuyers for cash. The mortgage will be paid off and any cash left over will be yours to keep.
In some instances, there is not enough equity in the home to make a cash sale possible. In some cases, we can catch up the payments on the mortgage and take over making the future payments. This will stop the foreclosure process. There are a couple of different ways of structuring this type of solution. We are happy to discuss them all with you.
